These Terms of Service ("Terms") govern your use of Jonny, an AI-powered Discord agent operated by ZeroTo1, LLC ("ZeroTo1," "we," "our," or "us"), deployed in private Discord servers owned by ZeroTo1's brand clients.
By interacting with Jonny in a ZeroTo1-managed Discord server, you ("you," "your") agree to be bound by these Terms. If you do not agree, do not interact with Jonny.
1. ELIGIBILITY
You must be at least 18 years of age to interact with Jonny and to participate in ZeroTo1-managed creator programs. By using the Service, you affirmatively represent that you are at least 18 years old. We do not knowingly permit anyone under 18 to use the Service.
The Service is offered only to creators located in the United States.
You must also comply with Discord's Terms of Service and Community Guidelines (available at https://discord.com/terms and https://discord.com/guidelines).
2. DESCRIPTION OF SERVICE
Jonny provides automated community management functionality within private Discord servers operated on behalf of brand clients. Functions include:
New creator onboarding (data capture with explicit consent, role assignment, welcome sequencing)
Performance-based role assignment in support of brand-specific creator programs
AI-powered responses to creator questions about brand campaigns and program logistics
Functional scheduled communications related to the creator program (campaign updates, leaderboards, program announcements). These communications are clearly attributed to Jonny as an AI agent. They are not designed to artificially inflate server activity, simulate user engagement, or impersonate human users.
Operational context updates from brand teams that are parsed and injected into Jonny's response context
Spam, scam, and policy-violation detection with automated removal
Weekly creator engagement and performance leaderboards
Escalation routing to ZeroTo1 community managers
3. USER CONDUCT
When interacting with Jonny, you agree NOT to:
Provide false, misleading, or fraudulent information during onboarding or in performance reporting (including GMV updates)
Use Jonny to attempt to access information you are not authorized to receive
Attempt to circumvent rate limits, role restrictions, ban actions, or other technical controls
Submit content that is unlawful, defamatory, harassing, infringing, obscene, threatening, or otherwise objectionable
Use Jonny to spam, scam, phish, distribute malware, or otherwise harm other creators, brands, or third parties
Sell or transfer your Discord account, brand-server access, or program eligibility
Reverse engineer, decompile, or attempt to extract source code from Jonny
Use automated tools to interact with Jonny at scale, except as explicitly permitted by Discord's API terms
Engage in activity prohibited by Discord's Terms of Service, Developer Terms of Service, Developer Policy, or Community Guidelines
Violation of these conduct standards may result in removal from the brand server, ban from ZeroTo1-managed programs, reporting to Discord, or other remedies available under applicable law.
4. AI-GENERATED RESPONSES AND DISCLAIMERS
Jonny is an AI agent powered by large language model technology provided by Anthropic, PBC. Responses are generated programmatically and may occasionally be inaccurate, incomplete, outdated, or otherwise imperfect.
You acknowledge and agree that:
Jonny's responses are not legal, financial, medical, tax, or professional advice
You should verify time-sensitive or high-stakes information with a ZeroTo1 community manager before acting on it
Jonny is designed to route uncertain questions to human community managers and does not fabricate program-specific rules, payment amounts, or campaign details
ZeroTo1 makes no warranty that Jonny's responses are accurate, complete, current, or fit for any particular purpose
5. DATA PROCESSING AND AI TRAINING
Your use of the Service is governed by our Privacy Policy, available at https://zeroto1.co/privacy. By using the Service, you acknowledge that you have read and agree to the Privacy Policy.
ZeroTo1 does not use your message content, file attachments, or any other Discord-derived data to train artificial intelligence or machine learning models. Anthropic, the provider of the underlying AI model, does not train its models on content submitted through its API.
ZeroTo1 does not sell your data and does not disclose your data to advertising networks, data brokers, or monetization services.
ZeroTo1 does not use your data to profile you, discriminate against you based on protected characteristics, or determine your eligibility for benefits, employment, housing, insurance, or any purpose outside the scope of the creator program.
6. BRAND PROGRAM PARTICIPATION
Your participation in any specific brand creator program is governed by separate agreements between you, the brand, and ZeroTo1. These Terms govern only your interactions with the Jonny Discord agent itself. In the event of any conflict between these Terms and your brand program agreement with respect to program-specific obligations, the brand program agreement controls for those specific matters.
Self-reported GMV (gross merchandise value) figures provided during program participation are creator program performance metrics, not financial information. ZeroTo1 does not collect bank account information, credit card information, tax identification numbers, or other regulated financial data through the Service.
7. INTELLECTUAL PROPERTY
ZeroTo1 retains all rights to Jonny, its underlying code, the Service, and any related materials. You retain ownership of content you submit in Discord, but you grant ZeroTo1 a non-exclusive, royalty-free license to use, store, and process that content as necessary to operate the Service consistent with our Privacy Policy.
You acknowledge that Discord, Inc. retains rights in the Discord platform, APIs, and branding, and that our use of the Discord Developer Platform is governed by Discord's Developer Terms of Service. ZeroTo1 will promptly delete API Data at Discord's request.
8. TERMINATION
ZeroTo1 may suspend or terminate your access to the Service at any time, with or without notice and with or without cause, including for violations of these Terms, the Privacy Policy, Discord's Terms of Service, or applicable law.
You may discontinue use of the Service at any time by leaving the relevant brand Discord server or by requesting deletion of your data per the Privacy Policy.
Upon termination, your right to use the Service ends immediately. The provisions of these Terms that by their nature should survive termination will survive, including Sections 4 (Disclaimers), 7 (Intellectual Property), 9 (Limitation of Liability), and 13 (Governing Law).
9. DISCLAIMER OF WARRANTIES
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. ZEROTO1 DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ZEROTO1 DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZEROTO1 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
ZEROTO1'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
11. INDEMNIFICATION
You agree to indemnify and hold harmless ZeroTo1, its officers, employees, contractors, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Service, your violation of applicable law, or your infringement of any third-party rights.
12. REPORTING ISSUES
If you wish to report a bug, concern, or policy violation regarding the Service, you may:
Use the /feedback slash command in your brand Discord server (primary in-product reporting channel)
Notify a ZeroTo1 community manager in your brand Discord server

We review all reports and take appropriate action.
13. CHANGES TO THESE TERMS
We may modify these Terms at any time. The revised version will be posted with an updated "Last Updated" date. Material changes will be communicated through our Discord servers or via direct notice at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
14. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of the State of North Dakota, USA, without regard to conflict of laws principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Cass County, North Dakota.
